Section 232 does not automatically stack with Section 301. The interaction depends on the product type and country of origin.

⚠ Critical Distinction for Steel

Section 232 applies to steel articles from all countries as the governing tariff. It does not stack with Section 301 on the same steel article — CBP applies Section 232 as the primary rate, not Section 301. However, downstream products that are not themselves "steel articles" (e.g., steel screws, steel furniture components) may face Section 301 tariffs from China at 25% or higher. How to Request a Product Exclusion

Product exclusion requests are reviewed by the Bureau of Industry and Security (BIS). Exclusions are company- and product-specific, valid for one year from grant date.

Prepare Product Description
Document the full product description including chemical composition, dimensions, grade, manufacturing process, and intended end-use. Identify the specific HTS code(s) and describe why domestic alternatives are unavailable or insufficient in quantity or quality.

Submit via Regulations.gov
File under docket BIS-2018-0002 (Steel) or BIS-2018-0003 (Aluminum). Include: importer name and address, product description, HTS classification, quantity and value of imports, domestic supplier inquiry documentation, and end-use statement.

BIS Review Period
BIS publishes exclusion requests for a 30-day public comment period. After comments close, BIS reviews and issues a decision — typically within 90 days of filing. Decisions are published in the Federal Register and on the BIS website.

Apply to CBP
Once granted, submit the exclusion grant notice to CBP along with your entry summary. The exclusion applies to entries after the grant date — not retroactively. Maintain records for 5 years per 19 CFR 163.
